Terms of Service

These Terms of Service constitute a legally binding agreement between you and Utilyx Hub governing your access to and usage of our in-browser diagnostic suites, visualizers, and creator utilities.

1. Acceptance of Terms & Legal Capacity

By visiting, browsing, testing assets upon, or otherwise accessing Utilyx Hub (accessible at utilyxhub.com and related subpaths), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service, our Privacy Policy, and our Legal Disclaimer & Fair Use Policy.

Capacity to Contract: You affirm that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction) and are fully capable and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. If you are accessing this site on behalf of a business, channel network, or legal entity, you represent that you hold actual legal authority to bind that entity to these Terms.

2. Local In-RAM Processing & No Data Recovery Warranty

Utilyx Hub provides creator software engineered strictly under a client-side in-memory architecture. Processing occurs within your local device's random-access memory (RAM) utilizing standard browser interfaces (including HTML5 Canvas, File API, and WebAssembly):

  • No Server-Side Persistence: Draft artwork, custom images, video URLs, comments, and strings analyzed on our site are never ingested, archived, back-propagated, or retained on our web servers.
  • Immediate Memory Expiration: Closing or refreshing your browser tab purges all active registers, allocated Blobs, and computational states. Utilyx Hub maintains no central backups, recovery vaults, or version histories. You are exclusively responsible for preserving original copies of all creative assets on your local system before loading them into our visualizers.

3. Third-Party Platform Disclaimers & Trademarks

Utilyx Hub provides independent analytics and layout testing sandboxes for social media ecosystems. We maintain complete institutional independence:

  • Non-Affiliation: Utilyx Hub is an independent software tool and is not endorsed by, sponsored by, affiliated with, authorized by, or in any way officially associated with Alphabet Inc., Google LLC, YouTube LLC, Meta Platforms, Inc., WhatsApp LLC, Instagram, or Apple Inc.
  • Nominative Fair Use: Wordmarks such as "YouTube", "WhatsApp", "Instagram", and corresponding logos or user interface aesthetics are registered trademarks of their respective corporate owners. Their display on Utilyx Hub is strictly for identification, compatibility reference, and educational comparative layout analysis under 17 U.S.C. § 107 (Nominative Fair Use).

4. Acceptable Use Policy (AUP) & Operational Restrictions

You agree to utilize Utilyx Hub only for lawful purposes in accordance with these Terms. You expressly agree that you will not:

  • System Exploitation: Attempt to probe, bypass, disrupt, flood, or overload our edge-cached serverless API gateways, rate limiters, or web hosting security headers.
  • Automated Scraping: Deploy malicious headless bots, distributed spiders, or automated scrapers designed to exhaust our public API quotas or compromise service availability for legitimate creators.
  • Unlawful Content Processing: Load, process, or render any media assets, strings, or images that are unlawful, libelous, defamatory, obscene, harassing, or that violate third-party intellectual property or privacy rights.
  • Malicious Code: Attempt to inject malicious scripts, cross-site scripting (XSS) vectors, or hostile code payloads into any interactive textarea, parameter field, or canvas object.

5. No Reliance on Projections, Estimations & YMYL Heuristics

All calculators, estimators, and simulation tools (such as the Super Chat Monetization Estimator, CPM models, and Thumbnail Standout scores) produce speculative mathematical models for educational and entertainment benchmarking only:

No Financial or Professional Advice: Output metrics do not constitute verified accounting, financial, legal, or tax counsel. Real-world creator revenues and algorithmic impressions depend on external variables—including AdSense auction bidding, viewer location, platform take-rates, tax withholding treaties, and policy updates—that cannot be predicted with mathematical certainty.

6. Ownership of Creative Assets & Intellectual Property

  • Your Creative Assets: You retain 100% of your ownership, copyrights, and intellectual property rights in all images, designs, scripts, and video metadata you load into Utilyx Hub. Because we do not upload or store your assets, we assert zero licensing claims or rights over your creative work product.
  • Utilyx Hub Platform IP: The design, structure, layout styling, proprietary scripts, custom SVG doodles, CSS theme engine, and editorial content of Utilyx Hub are the intellectual property of Utilyx Hub and are protected by applicable copyright and trademark laws. You may not duplicate, redistribute, or frame our platform architecture without explicit written consent.

7. "As-Is" Disclaimer & Comprehensive Limitation of Liability

Utilyx Hub is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

To the maximum extent permitted by applicable law, Utilyx Hub, its developers, operators, and hosting infrastructure shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages—including loss of profits, channel strikes, algorithmic changes, data loss, or business interruption—arising out of or related to your use of this service.

Sole & Exclusive Remedy ($0.00 Limit): Because Utilyx Hub is made available free of charge without recurring paid subscription fees, your sole and exclusive remedy for any grievance or claim is to discontinue using the platform immediately. In any jurisdiction where limitations of liability are restricted, aggregate liability shall not exceed Zero United States Dollars ($0.00 USD).

8. Modifications to Terms & Formal Communications

We reserve the right to revise or update these Terms of Service at our sole discretion at any time. Continued usage of Utilyx Hub following the publication of revised terms constitutes your binding acceptance of the modified Terms.
